Been getting a lot of these questions so let me start with the disclaimers. If your amount is over $10,000 you have to go to the next step up – at that point a lawyer is the way to go. Just remember.
- I am not a lawyer, this is not legal advice. I am laying out a step by step guide on how you can copy my steps.
- Winning is the easy part, collecting is often very tough. Set the expectation that you are going to spend around $600 and while a ‘W’ on that judgement will make you feel good, you then need to collect. However, if you are happy adding to the list of cases on his record – file away!
- You will get a zoom link so you do not have to go to Illinois to attend court.
- Be prepared to be threatened, a lot, but know that truth is an absolute defense against defamation or any other nonsense rebuttals they offer.
You will need 3 things to file in small claims court for amounts below $10,000 in the State of Illinois. (see linked instructions HERE)
- Small Claims Complaint form (optional additional defendants or reasons forms)
- Small Claims Order form
- Summons (you have to notify Ryne and anyone else involved)
*I am not sure if you can file in your home state if that’s your preferred method consult with a lawyer. I didn’t want him to have any excuses or outs, so I brought the fight to him.
Step 1. Begin at the Illinois Courts.Gov HERE

Step 2. Scroll down and click ‘Small Claims Complaint’

Step 3. That will take you to this blank form ‘Small Claims Complaint’ Also, not a bad idea to read the first two links about getting started and file & serving.
Step 4. Fill out the Additional form if you need the space.

Step 5. Fill out the Small Claims Summons form. One for each defendant.

Step 6. Fill out the small claims order form.

Step 7. Once all filled out you should have a small pile of attachments that look like this. Side note if you do not have adobe you can use Illinois Legal Aid Online to fill out the forms as well in one package. However, that website is a little more difficult to navigate compared to the one above. Here it is if you want to check it out. https://www.illinoislegalaid.org/

Step 8. Next you are going to go to eFile Illinois – https://efileil.tylertech.cloud/OfsEfsp/ui/landing?returnUrl=%2Fdashboard and create and account.

Step 9. Click start filing in the blue bar on the upper left.

Step 10. Below is how I filled out my application. His Illinois bar license address is in Schaumburg, Illinois. So I filed here. Municipal Civil – District 3 – Rolling Meadows. Case category – Civil. Case Type – Breach of Contract – Small Claims $0 to $10,000 – Non-Jury – Self-Represented Litigant.

Step 11. Fill out the appropriate parties.

Step 12. Under filings I put filing code ‘Complaint / Petition – Breach Of Contract – Fee’ Then below this is where you add all the documents for your case.

Step 13. Additional service. This is where it gets tricky on how you want to serve him. I will let you do your own research and find out if you want to send him certified mail or have the sheriffs serve him (you need an address regardless). I chose the sheriffs as I wanted to put my best foot forward in having him served so he couldn’t report otherwise.

IF you want to go the sheriff route you will have to file the summons here – only after its been accepted by the court registrars.

Step 14. Check your dashboard for the acceptance date and scheduled court time.
Step 15. Once you have your scheduled court date fill out your subpoenas requests.
